Robert Rosing
Managing Partner
Robert Rosing has deep experience in home owner association law, real estate law, and business disputes. Robert’s clients include community associations, buyers and sellers of real property, homeowners in disputes with their neighbors, real estate developers, business owners, and individuals. Robert is a graduate of the University of Chicago and Georgetown University Law Center, where he graduated cum laude and served as the Editor-in-Chief of the Georgetown International Environmental Law Review.
Community Association Law:
Robert represents some of the largest homeowner associations and condominiums in the state of Utah (and also some of the smallest). He regularly speaks with and advises the boards of these association on a wide variety of topics including: enforcement of CC&Rs, drafting new rules and regulations, amending the CC&Rs and bylaws, collections of unpaid assessments, and litigation (avoiding it and prosecuting it). Robert also helps his clients with the day to day business of operating an association including meeting procedures, voting, notices, ballots, proxies, notice and related items. In litigation, Robert has represented associations in disputes with contractors, owners, vendors, and neighboring land owners.
On the homeowner side, Robert has successfully represented homeowners in disputes against HOAs on a variety of matters including obtaining reasonable accommodation under the Fair Housing Act, helping owners rent their unit despite an HOA’s attempt to enforce rental restrictions, and aiding an owner in overcoming the imposition of thousands of dollars in fines for alleged violations.
Real Property:
Robert regularly represents buyers and sellers of real estate, including simple reviews of the purchase documents and disclosures, to more complicated issues such as dealing with boundary disputes and easements. Robert also represents landowners in disputes with their neighbors, including easement disputes, boundary disputes, encroachments, and nuisances.
Business Owners:
Robert represents business owners in Utah. He works as general counsel giving advice on business disputes, corporate formation, contracts, and many other issues. Robert also represents business owners in litigation.
Robert filed to form the community association law section of the Utah State Bar and was elected as the inaugural chairperson of the Section. Robert is active in the Utah chapter of the Community Association Institute and served as the president of the Chapter. Robert was named a Rising Star by Mountain States Super Lawyers. Robert is also a licensed continuing education presenter for the Park City Board of Realtors.
After graduation, Robert practiced law at the 700 hundred lawyer firm of Heller Ehrman in Seattle, Washington and at the 130 lawyer firm of Cohen & Grigsby, P.C. in Naples, Florida, before moving Utah. After moving to Utah, Robert practiced law for several years before starting his own firm. Robert brings extensive experience and understanding to the Community Association law practice. When Robert is not working, he enjoys mountain biking, skiing, and traveling.
